Terms of Service

1. Acceptance of Terms

By accessing or using NEXA 360 ("the Service"), operated by Nexa Agency ("we", "us", "our"), located in the United States, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

NEXA 360 is a business intelligence and marketing automation platform that helps users find potential clients, generate outreach campaigns, and manage business relationships. The Service uses publicly available data from Google Maps and other public sources.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use this Service.

4. Plans and Pricing

NEXA 360 offers the following subscription tiers:

  • Starter (Free): Limited scans, leads, and campaigns. No credit card required.
  • Pro ($29/mo or $24/mo billed annually): Increased limits, AI Strategy advisor, review management, and weekly fresh data.
  • Business ($79/mo or $63/mo billed annually): Unlimited usage, real-time data, GBP Post Scheduler, health reports, and priority support.
  • Enterprise (Custom pricing): Multi-seat, white-label, API access, dedicated account manager, and custom integrations.

Prices are in US dollars. We reserve the right to change pricing with 30 days advance notice to existing subscribers.

5. Billing, Cancellation, and Refund Policy

Paid plans are billed through Stripe on a recurring basis (monthly or annually, depending on your selection).

Cancellation

You may cancel your subscription at any time from your account dashboard or by contacting us. Upon cancellation:

  • Your access continues until the end of the current billing period.
  • No further charges will be made after cancellation.
  • Your account reverts to the Starter (Free) plan at the end of the paid period.
  • Your leads and campaign data are retained for 90 days after downgrade, then permanently deleted.

Refund Policy

  • Monthly plans: No refunds. You may cancel at any time, and you keep access until the end of your current billing cycle.
  • Annual plans: You may request a full refund within 14 days of your initial purchase if you have not exceeded 10 scans. After 14 days or 10 scans (whichever comes first), no refunds are issued.
  • Service outages: If the Service is unavailable for more than 72 consecutive hours due to a fault on our end, you may request a prorated credit for the affected period.
  • Chargebacks: Filing a fraudulent chargeback (where you received and used the Service) will result in immediate account suspension and potential collection action.

Free Trial

The Starter (Free) plan serves as your trial. It provides full access to core scanning features at no cost and with no credit card required. We encourage you to use the Free plan to evaluate the Service before upgrading.

6. Acceptable Use

You agree NOT to:

  • Send spam, unsolicited bulk messages, or harassing communications
  • Use the Service to violate any applicable laws, including CAN-SPAM Act, TCPA, or GDPR
  • Attempt to access other users' data or accounts
  • Use the Service to scrape, harvest, or collect personal information for illegal purposes
  • Misrepresent your identity or affiliation in outreach communications
  • Resell access to the Service without written authorization
  • Use automated tools, bots, or scripts to interact with the Service beyond normal use
  • Share, transfer, or sell your account credentials to any third party

7. Outreach Compliance

You are solely responsible for ensuring your outreach communications comply with all applicable laws, including the CAN-SPAM Act. All outreach emails sent through the Service must include a valid unsubscribe mechanism and your accurate sender information. We provide tools to help with compliance but you bear ultimate responsibility.

8. Data and Content

You retain ownership of any content you create using the Service. We retain the right to use anonymized, aggregated data to improve the Service. Business data displayed in the Service comes from publicly available sources (Google Maps, public directories) and we make no guarantees about its accuracy or completeness.

Upon account deletion or subscription downgrade, your data is retained for 90 days, then permanently deleted. During this period you may request a data export by contacting support.

9. Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. The Service depends on third-party providers (Google Maps, Stripe, Supabase) whose availability is beyond our control. Scheduled maintenance will be announced at least 24 hours in advance when possible.

10. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST REVENUE, LOST PROFITS, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PRECEDING 12 MONTHS.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in abusive behavior, or use the Service in a way that harms other users or our infrastructure. You may delete your account at any time by contacting us at support@nexaagency360.com.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Service at least 14 days before they take effect. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.
